# PAWCO — Terms & Conditions of Sale

These Terms & Conditions of Sale ("Terms") apply to every purchase you make from PAWCO. Please read them before placing an order. By placing an order with us, you agree to these Terms.

## 1. Who we are

PAWCO is a trading name of **ARCA Sustainability Pty Ltd** (ABN 70 684 953 571), based in Western Australia ("PAWCO", "we", "us", "our").

## 2. Acceptance of these Terms

By placing an order through our website or via Instagram, you confirm that you have read, understood and agree to these Terms. By ordering, you also confirm that you are at least 18 (the age of majority in your State or Territory) and able to enter a binding contract. If you do not agree, please do not place an order.

We may update these Terms from time to time. The version that applies to your order is the one published on our website at the time you place it.

## 3. Our products

We sell a dog harness with an integrated retractable leash, along with any related accessories listed on our store.

We try to describe and picture our products as accurately as possible. Colours may vary slightly depending on your screen, and minor variations between units can occur. Sizing guidance is provided to help you choose — please measure your dog carefully, as choosing the wrong size is the most common reason for an exchange.

## 4. Prices and payment

- All prices are in **Australian dollars (AUD)** and include GST where applicable.
- Payment is required in full at the time of order, through the payment methods shown at checkout.
- We make every effort to ensure prices are correct. If we discover a pricing error after you order, we will contact you and give you the choice of confirming the order at the correct price or cancelling it for a full refund.
- Prices and product availability may change at any time. Any change won't affect orders we have already accepted.

## 5. Orders and acceptance

Your order is an offer to buy. A contract is formed only when we send you an order confirmation or dispatch your goods.

We may decline or cancel an order — for example, if the product is out of stock, there has been a pricing or description error, or we reasonably suspect fraud. If we cancel an order you have paid for, we will refund you in full.

## 6. Delivery

- We aim to dispatch and deliver within the timeframes set out in our Shipping & Delivery Policy. Delivery estimates are estimates only, not guarantees.
- Risk in the goods passes to you on delivery. If your order is damaged in transit, this is treated as a faulty product under section 8 below — contact us promptly with photos.
- You are responsible for providing a correct and complete delivery address.

## 7. Your rights under the Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (ACL) that cannot lawfully be excluded.

**Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.** You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have a problem with the goods remedied if they are not of acceptable quality and the failure does not amount to a major failure.

These rights apply regardless of anything else in these Terms or in our returns policy below.

## 8. Faulty, damaged or not-as-described products

If a product is faulty, damaged on arrival, or significantly different from how it was described, you are covered by the consumer guarantees above. Here is how we handle it:

- **Contact us** at hello.pawco@gmail.com.au
with your order number and photos or a short video showing the problem.
- **Major problem** (for example, the leash mechanism fails unsafely, or the product is very different from its description): you choose between a **full refund or a replacement**.
- **Minor problem:** the ACL allows us to choose the remedy. **We do not offer repairs** — instead we will provide a **replacement or a refund**.
- A refund is for the **full amount you paid**, with no deduction for use, returned to your original payment method unless we agree otherwise.
- If the product is confirmed faulty, **we reimburse your reasonable return postage**. If, after assessment, the product turns out not to be faulty, we may pass on reasonable collection and inspection costs — but only where we have given you an estimate of those costs first.
- You do not need the original packaging to make a claim, but we may ask for proof of purchase.

We will never ask you to take a faulty product to the supplier or manufacturer — resolving it is our responsibility.

## 9. Change-of-mind returns (goodwill policy)

This section is a goodwill policy and is **separate** from your consumer guarantee rights in sections 7 and 8. It is set out in full in our Returns & Refunds Policy and summarised here.

We do **not** offer cash refunds for change of mind. As a goodwill gesture, we accept **one change-of-mind return per order**, resolved by **exchange or store credit**, on the following conditions:

- You request it within **15 days** of delivery.
- The product is **unused, unworn** and in **original condition**, with all tags and original packaging.
- You provide proof of purchase.
- You cover the cost of return postage.

If an item is faulty, the process in section 8 applies instead — including your right to a refund. We are not required to accept change-of-mind returns beyond this goodwill offer.

## 10. Product safety and correct use

Your dog's safety matters to us. To use the harness and leash safely, and to keep your consumer guarantee rights intact:

- Choose the correct size using our sizing guide and observe the maximum dog-weight guidance.
- Follow the fitting instructions supplied with the product.
- Check the harness, leash and all hardware before each use for wear or damage.
- Follow the care instructions — for example, do not machine wash unless the care guidance says you can.
- Supervise your dog while the product is in use. The product is not designed as a tie-out, a vehicle restraint, or for unattended restraint.

Products are covered by the consumer guarantees, but those guarantees do not apply to problems caused by misuse, failure to follow instructions, or normal wear and tear. If you become aware of a safety issue with one of our products, please contact us so we can act on it.

## 11. Limitation of liability

Nothing in this section limits or excludes any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded — those rights (set out in section 7) always apply.

Subject to that, and to the extent permitted by law:

- We are not liable for any indirect, incidental or consequential loss, or for any loss of profit, savings, data, or business, arising from your purchase or use of our products.
- Our total liability to you in connection with any product is limited, at our option, to replacing the product or refunding the price you paid for it.

## 12. Your responsibilities and indemnity

You are responsible for using our products safely and lawfully, in line with the safe-use guidance in section 10 and the instructions supplied with the product.

To the extent permitted by law, you agree to compensate us for any loss, damage, cost or claim we suffer that is caused by your breach of these Terms, your misuse of a product, or your unlawful use of a product. This does not apply to any loss caused by our own act or omission, and nothing in this section affects your rights under the Australian Consumer Law.

## 13. Intellectual property

The PAWCO name, logo, product designs, images and website content are owned by ARCA Sustainability Pty Ltd or used under licence, and are protected by law. You may not copy or use them without our written permission.

## 14. Privacy

We handle your personal information in accordance with our Privacy Policy, available on our website. Please read it to understand how we collect, use and protect your information.

## 15. Governing law

These Terms are governed by the laws of **Western Australia**, and you and we submit to the jurisdiction of the courts of Western Australia.

## 16. Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision is severed and the remaining provisions continue in full force.

## 17. Entire agreement

These Terms, together with our Returns & Refunds Policy, Shipping & Delivery Policy and Privacy Policy, make up the entire agreement between you and us about your purchase. If we do not enforce a provision on any occasion, that is not a waiver of it.
